The Frostig School is committed to providing a safe school environment where all individuals
are afforded equal access and opportunities. To meet this goal, the school’s academic and other
educational support programs, services, and activities shall be free from discrimination,
harassment, intimidation, and bullying of any individual based on the person’s actual race,
color, ancestry, national origin, ethnic group identification, age, religion, marital or parental
status, physical or mental disability, sex, sexual orientation, gender, gender identity, or gender
expression, the perception of one or more of such characteristics, or association with a person
or group with one or more of these actual or perceived characteristics. Specifically, federal law
(Title IX) prohibits discrimination on the basis of gender in recruitment, financial assistance,
enrollment, counseling, and the availability of physical education, athletic activities, and sports.
Transgender students shall be permitted to participate in gender-segregated school programs
and activities (ex: athletic teams, sports competitions, and field trips) and to use facilities
consistent with their gender identity. Speaking a language other than English will not be a
barrier to admission or participation in school programs. Pregnant and parenting teens are also
covered under Title IX.

Is there a statute of limitations for filing an alleged incident of harassment or discrimination?

Written complaints regarding alleged incidents of harassment or discrimination should be filed within 6 months from the date the alleged incident occurred or from when the complainant first obtained knowledge of the alleged incident.

How may a discrimination complaint be filed beyond the statute of limitations?

A discrimination complaint may be filed beyond the statute of limitations by submitting a written request to the Title IX Coordinator. The written request must contain the reasons for the extension. The period for filing a complaint may be extended by the Title IX Coordinator for good cause for a period not to exceed 90 days following the expiration of the 6 month time period. The Title IX Coordinator shall respond immediately upon receipt of a request for an extension.

How are discrimination complaints investigated?

When a complaint is filed, it is given directly to the Title IX Coordinator. The written complaint will be time and date stamped to document the beginning of the timeline for responding to the complaint. The Title IX Coordinator will lead the investigation and contact all applicable parties to request data, responses, and evidence. Within 60 days of the receipt of the written complaint, a written report of findings will be issued to the complainant. The written report will contain the allegations, method of investigation, school policy, findings, conclusions, corrective actions, and appeal options, if applicable. The 60 day timeline may be extended only by mutual agreement of the complainant and the Title IX Coordinator.

How do I file a discrimination complaint?

Any individual, agency, or organization may file a written complaint alleging a violation of federal or state laws governing the programs and activities, as well as allegations of discrimination, harassment, intimidation, and/or bullying. The complaint should include a summary of the incident and the alleged violations. Complaints can be filed anonymously if it provides evidence or information leading to evidence that supports an allegation of noncompliance. Verbal complaints will be referred to an administrator or designee who will assist any person who will assist with creating the written complaint. Written complaints should be sent to the Title IX Coordinator:
